The victim was fighting for life after his ute was rear-ended and rolled in Kogan, west of Toowoomba, about 2am on Tuesday.

Police allege the driver of a Nissan X-Trail twice deliberately rammed a Holden Colorado from behind on May 30, causing it to overturn.

Three people were injured, including a 22-year-old Goranba man who was flown to the Princess Alexandra Hospital, where he died from his injuries.

A 20-year-old female passenger was seriously injured and also airlifted to Brisbane, while a two-year-old boy escaped with minor injuries and is being treated at the Tara hospital.

A 36-year-old Tara man was initially charged with the dangerous operation of a vehicle causing grievous bodily harm.

Police have upgraded the charge to one count of murder and two of attempted murder.

Detective Inspector Garry Watts said the accused had been in a relationship with the woman and child who were passengers in the damaged vehicle.

“This matter arose out of a domestic and family violence incident and we are examining the relationship and the occurrences that occurred as a result of this as part of our investigation,” Watts told reporters on Thursday.

The victim and the accused were also known to one another, and the police had previous dealings with those involved in the fatal incident.

Police refused to confirm if the woman and child had been involved in a dispute with the accused leading up to the fatal incident.

The 36-year-old man is due to appear in Dalby Magistrates Court on Thursday.

Police have appealed for witnesses or anyone with dashcam footage to contact them.

Meanwhile police have launched a homicide investigation after a man died at a Gold Coast hospital several days after a serious assault.

Authorities made a public appeal for information on Wednesday relating to an incident outside Sanctuary Cove’s Destino Wine and Cocktail Bar about 9.20pm on Saturday.

A 39-year-old man, Michael Hayes, left the restaurant and was seen talking to a man, who a short time later struck Hayes to the head.

Hayes suffered critical injuries, before dying in hospital on Thursday.

The perpetrator is described as Caucasian, between 20 and 30 years of age, with short dark hair. He was wearing dark tracksuit pants and a dark shirt, and had a satchel over his shoulder.

Police are calling for witnesses or anyone with dashcam footage from the Sanctuary Cove and Hope Island areas between 9pm and 10pm on Saturday to come forward.

Operation Victor Lacerta is under way as police continue their investigations.
